Bradshaw Entertainment, LLC, dba Continuum VR (hereinafter “Continuum VR”) is a business which offers virtual reality experiences. These terms and conditions govern the relationship between Continuum VR and you, the user, customer, guest, invitee, client, etc. (hereinafter “Participant” “you” or “your”), to participate in the services or experiences which may be offered by Continuum VR. These terms and conditions do not entitle Participant entrance or access into facilities owned by Continuum VR outside of normal and/or ordinary business hours, nor do these terms and conditions allow Participant a right to use Continuum VR facilities in a manner inconsistent with the virtual reality services/experiences and their intended purposes.
Please review these terms and conditions thoroughly as such are incorporated into your Service Agreement and are therefore a part of the legal contract between Continuum VR and Participant. By using the Services, Participant agrees to the terms and conditions of this Agreement.
All Participants that use Continuum VR’s services shall be assumed to be 18 years of age or older, or in the case of a minor participant, that the Participant is the parent or legal guardian of the minor participant. By using Continuum VR’s services, Participant incorporates responsibility of proof of legal age and/or guardianship. Participant acknowledges and agrees that they are solely responsible for actions, injuries, and behavior of any minor participant listed on the service agreement.
By entering into an agreement with Continuum VR, using the premises, facilities and equipment of Continuum VR and its subsidiaries, Participant hereby acknowledges on behalf of itself, its heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in virtual reality immersive experiences. By using Continuum VR’s services, Participant represents that he/she is covered under their own insurance policies, covering any injuries to them personally or which may be caused to them by others. Participant agrees to deal directly with their own carrier and not Continuum VR.
Participant acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. Participant also acknowledge that the specific risks vary from one activity to another, but range from (1) motion sickness, dizziness, slipping, falling, or other physical instabilities which may result in minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death.
At all times, Participant shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to Participant by staff. If in the subjective opinion of the Continuum VR staff, Participant would be at physical risk participating in Continuum VR’s Classes, Participant understands and agrees that Participant may be denied access to use Continuum VR’s services until Participant furnishes Continuum VR with an opinion letter from Participant’s medical doctor, at Participant’s sole cost and expense, specifically addressing Continuum VR’s concerns and stating that Continuum VR’s concerns are unfounded.
In consideration of being allowed to participate in and access Continuum VR’s facility and the virtual reality services offered by Continuum VR, Participant hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by Participant in relation to Continuum VR’s facility and/or services, (2) release, indemnify, and hold harmless Continuum VR, its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Classes or use of the Facilities, and (3) represent that Participant (a) has no medical or physical condition that would prevent Participant from properly using any of Continuum VR’s facilities and/or services, (b) do not have a physical or mental condition that would put Participant in any physical or medical danger, and (c) have not been instructed by a physician to not participate in virtual reality experiences. Participant acknowledges that if Participant has any chronic disabilities or conditions, Participant is at risk in using Continuum VR’s facilities and/or services and should not be participating in such activities. PARTICIPANT FULLY ASSUMES THE RISK THAT THEY MAY SUFFER PROPERTY DAMAGE, ILLNESS, SEVERE PERSONAL INJURY, OR EVEN DEATH BY USE/PARTICIPATION IN CONTINUUM VR SERVICES.
Continuum VR is committed to the health, safety, and welfare of each of its participants and will not tolerate unreasonable, threatening, obscene, harassing, indecent or illegal behavior. Participants who do not observe Continuum VR’s rules and regulations or who abuse its facilities and/or its equipment in any fashion will be asked to leave. Continuum VR has the right to judge behavior and respond accordingly. This right includes, but is not limited to termination of a participant’s ability to continue using a service without refund to any participant engaging in unacceptable behavior. The participant shall pay for any damages to Continuum VR property which results from the willful or negligent conduct of any participant, participant’s guest, or participant’s dependent child. Not all rules and regulations are listed in these terms and conditions. Continuum VR reserves the right to add, change or remove rules, conditions of participation, opening and closing hours, services and or the service details, and all services and facilities offered by Continuum VR.
Participant hereby grants Continuum VR, its representatives, employees, or agents the right to take photographs and video footage of Participant and Participant’s property while at Continuum VR and to use and publish these photos or videos in print and/or electronically for marketing or other business purposes. Participant agrees that Continuum VR may use photographs or video footage of Participant with or without Participant’s name for any lawful purpose, including for such purposes as publicity, illustration, advertising and web content.
Virtual Reality is a VERY immersive experience and can affect everyone differently.

People who have previous medical conditions such as severe headaches, earaches, or
psychiatric disorders, should see a doctor before participating in and/or using VR headsets. Some people may experience seizures triggered by flashing lights or patterns while experiencing virtual reality, even if they have never had a seizure before, or have no history of epilepsy or seizures.
Anyone who knows or believes they may have previously experienced a seizure or other
symptom linked to an epileptic condition should see a doctor prior to using our VR headsets.
People who are prone to motion sickness have a risk of experiencing discomfort when using
Virtual Reality. Do not use when you are sleep deprived, are under the influence of drugs or
alcohol, or have digestive problems.
Children under the age of 13 must be accompanied by an adult over the age of 18. Children under the age of 18 are not able to play games that carry a mature age restriction.
